This Privacy Policy describes how Tristan, through all channels of communication, whether online on our website in Canada at https://www.Tristanfleet.com, when using our mobile application, or in person in any of our TRISTAN Stores (the “Site”, “we”, “us”, or “our”) collects, uses, and discloses the personal information (as defined below) of its visitors (“you”, “your”, or “yours”). 

We are committed to protecting your privacy rights and recognize the importance of protecting the information that we collect about you. We have prepared this Privacy Policy to describe to you our practices regarding the personal information we collect: 

  • directly from users of our Site and recipients of our emails, including use of any of our services (through a mobile device, mobile application or otherwise) or other offerings (collectively, the “Services”); 
  • when you purchase any of our products (“Products”); and

Tristan Fleet Management Inc. (“Tristan”) is the exclusive licensee of the trademarks of the TRISTAN brand in Canada and the United States, respectively, including for the purposes of operating these Sites. The terms of this Privacy Policy cover all of our operations through the Sites and our stores in Canada. Your data controller is Andy Corporation North America Inc. (and Tristan Fleet Management Inc.), a Quebec company registered under enterprise number 1177722254 and having its offices at 2955 boul. Jean-Baptiste-Deschamps Montréal (Québec) H8T1C5 Canada. In other words, Andy Corporation North America Inc. is responsible for collecting, processing and protecting your personal data. 

The region-specific terms of this Privacy Policy only apply to the Tristan entity that is in such geographic locations, or as applicable law requires. 

3. Your Right to Control How Your Personal Information is Used 

You have the right to make requests regarding your personal information. You can: 

  • Review the personal information we have about you or request a copy of it 
  • Ask us to update or correct personal information if it is inaccurate 
  • Request that we delete your personal information 
  • Opt-out of sharing your personal information with third parties for some purposes, including sharing that may be defined as sale under applicable laws 
  • Object to certain types of uses of your personal information 
  • Make choices about receiving email marketing 
  • Tell us which cookies you want us to use when you shop online 

These rights vary depending on where you reside. But we will make reasonable efforts to honor your request, even if your country or state does not require us to do so. If your shopping is interrupted, they remember where you left off and send you reminders that you truly deserve that new part. We think these cookies are useful and will make it easier for you to shop with us. But you might disagree. If so, you can tell us not to use certain cookies by using the opt-out tools we have placed on our ecommerce websites. These options vary by geographic region 

Interest based marketing and Targeting 

We may use your personal information to provide you with targeted advertisements or marketing communications we believe may be of interest to you (interest-based advertising). 9. How we store Your personal information. 

Tristan is a global company with a global footprint, but the majority of the personal information that we collect is stored in Canada and the United States. Your personal information may be subject to the laws of the countries in which it is stored or used. By providing us with any personal information, you understand that your information may be transferred, processed, or stored outside of your country of residence, including the United States, which may have a different data protection regime from the country in which you reside. In certain circumstances, courts, law enforcement agencies, regulatory agencies, or security authorities in those other countries may be entitled to access your personal information. 

10. Retention of Your Personal Information 

When you place an order for Products through the Site, we will retain your personal information for our records as long as it serves the purpose(s) for which it was initially collected as stated in this Privacy Policy, subsequently authorized, as necessary or appropriate to provide the Services, and for business continuity purposes, unless and until you ask us to erase this information. We also retain information as permitted or required under applicable law to comply with applicable law, to resolve disputes, and to enforce our rights and agreements. if we are unable, for technical reasons, to delete some information from our systems, we will inform you and put in place appropriate measures to prevent any further use of the data. We may use anonymized data indefinitely.

11. International Visitors 

The Sites are hosted in Canada and are intended for users located in Canada. However, like almost every website, our Sites can be accessed by international visitors. If you are located outside of Canada, please be aware that information we collect, including personal information, will be transferred to, and processed, and stored in in Canada. The data protection laws in Canada may differ from those of the country in which you are located, and your personal information may be subject to access requests from governments, courts, or law enforcement in Canada according to laws of Canada. The Sites may contain links to other websites and may include or contain certain social media or other features provided by third party platforms (i.e., the ability to share to Facebook or the Facebook Like button). These features may collect certain of your information and may set a cookie to enable the feature to function properly. The use of these third-party feature may involve the third-party operator providing certain information, including personal information, to us. If you click on social media icons on the Website (such as for Facebook, Twitter or Instagram), we may have access to your personal information you provided on those third-party sites or applications. The Sites are not intended for individuals under the age of 13. We do not knowingly collect personal information online from visitors in this age group without parental consent.
